1. Ownership of Website Components
1.1 Client-Owned Content & Media
- The client retains full ownership of all text, images, videos, logos, and other media they provide or upload to the website.
- Upon request, the client may receive a backup of their media and text content in a standard format (e.g., text files, image downloads, database export).
1.2 Custom WordPress Theme & Code
- The custom WordPress theme, including its design, structure, stylesheets (CSS), JavaScript functionality, and PHP code, remains the intellectual property of Ateljee.
- The client is granted a non-exclusive, non-transferable license to use the theme only while hosted on Ateljee’s servers or an authorized hosting environment managed by Ateljee.
- The client cannot download, copy, redistribute, or use the custom theme on another service provider’s hosting environment.
1.3 Third-Party Plugins & Frameworks
- The website may include third-party frameworks, plugins, and fonts, such as Bootstrap, FontAwesome, Swiper, Google Fonts, and other open-source WordPress plugins.
- These components are subject to their respective licenses and terms of use. The client may need to obtain separate licenses if they wish to use them independently.
2. Website Transfer & Restrictions
2.1 Hosting & Migration Policy
- The custom theme is provided as a service and is not transferrable to another hosting provider unless explicitly agreed in writing.
- If the client requests to transfer their website to another host, they will receive:
- A database export (excluding proprietary theme-related configurations).
- A backup of their content only (text, images, and media uploads).
- Instructions on how to manually reconfigure certain elements using third-party plugins.
- The custom theme will not be included in the transfer unless a separate licensing fee is agreed upon.
2.2 Rebuilding on Another Hosting Provider
- If the client wishes to use another hosting provider, they must rebuild the website using an alternative theme or purchase a separate theme license from Ateljee.
- Any unauthorized duplication, redistribution, or modification of the theme outside of Ateljee’s hosting environment is strictly prohibited.
3. Termination & Access Rights
- If the client discontinues hosting with Ateljee, access to the website and custom theme will be revoked.
- The client is responsible for exporting their content before termination.
- Any unpaid balances must be settled before initiating any migration process.
4. Dispute Resolution
- Any disputes regarding ownership or website access will first be addressed through negotiation. If unresolved, the matter will be handled according to [Jurisdiction] laws.
